Terms of Service

These Terms of Service ("Terms") govern your access to and use of the websites, applications, and services (the "Services") provided by EverBetterApps ("EverBetterApps", "we", "us", or "our"). By using the Services you agree to these Terms.

1. Who we are

EverBetterApps is an independent software studio. Contact details are available at the contact section of our website or by email at hello@everbetterapps.com.

2. Accounts

To access certain Services you may be required to create an account. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. You must provide accurate information and keep it up to date.

3. Subscriptions and payments

Some Services are offered on a subscription basis. By subscribing you authorize us, through our payment processor, to charge the recurring fee shown at checkout for each billing cycle until you cancel.

• Subscriptions renew automatically at the end of each billing period.
• You can cancel at any time from your account; the cancellation takes effect at the end of the current billing period.
• Prices are shown in EUR unless otherwise indicated and exclude applicable taxes.

4. One-time services

Custom development and consulting services are billed according to the proposal signed by both parties. Unless otherwise stated, invoices are due within 14 days.

5. Acceptable use

You agree not to misuse the Services. You will not:

• Attempt to access accounts or data that do not belong to you.
• Probe, scan, or test the vulnerability of any system without authorization.
• Use the Services to send spam or unlawful content.
• Use the Services to build a competing product.

6. Intellectual property

The Services and all content provided by us (excluding your data and content) are owned by EverBetterApps and protected by intellectual property law. We grant you a limited, non-exclusive, non-transferable license to use the Services in accordance with these Terms.

7. Your content

You retain all rights to the content and data you submit to the Services. You grant us a limited license to host, store, and process that content solely to operate and improve the Services for you.

8. Service availability

We work hard to keep the Services available but we do not guarantee uninterrupted access. We may modify, suspend, or discontinue all or part of the Services at any time, with reasonable notice when possible.

9. Disclaimer of warranties

The Services are provided "as is" and "as available" without warranty of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement.

10. Limitation of liability

To the maximum extent permitted by law, EverBetterApps shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues. Our total liability for any claim arising out of or relating to the Services shall not exceed the amount paid by you to us in the 12 months preceding the claim.

11. Termination

You may stop using the Services at any time. We may suspend or terminate your access if you breach these Terms or use the Services in a way that could cause harm to us or others. On termination, your right to use the Services ends immediately.

12. Changes to these Terms

We may update these Terms from time to time. If the changes are material, we will provide notice (for example by email or through the Services). Your continued use of the Services after a change takes effect constitutes acceptance of the updated Terms.

13. Governing law

These Terms are governed by the laws of Portugal, without regard to its conflict-of-law principles. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts of Portugal.
